学界有关环境共同侵权的理论争议并未因2010年《侵权责任法》的出台而偃旗息鼓,反而因该法条文表述模糊、体系构建不清等原因呈愈演愈烈之势。与此同时,有关该法的条文适用、新旧法衔接、条文规定与理论研究之间的对应等问题又成为学界争议的新焦点。目前正处于《侵权责任法》颁布初期,环境侵权救济制度构建的初始阶段,笔者认为十分有必要针对争议性较大的问题展开研究,以为明晰理论、构建体系、完善立法尽绵薄之力。

Tort Law of the People's Republic of China was promulgated and came into force on July 1,2010;however this does not quell the theoretical controversy on the Environmental Joint Tort Liability but make it acuter,because of the vague interpretations and unclear system construction.Meanwhile,how to apply the provisions of the Tort Law,how to converge the Tort Law and some related laws which have been enacted,how to connect the provisions of the Tort Law with the theoretical research has become a new focus of academic controversy.As it is in the early issue of the Tort Law and initial construction stage of the tort relief system,the authors believe that a study is necessary to address the problem.This article is a study focusing on these problems in order to provide our contribution in clearing theory,building systemand improving legislation.
